    The dispute between�Apple (NASDAQ: AAPL  ) �and Samsung�is reaching into the highest office of the land. The decision will enter a 60-day review process that includes President Obama. Bloomberg reports that the U.S. International Trade Commission ruled early this week that Apple would be banned from importing the iPhone 4 and the iPad 2 3G because the devices infringe a Samsung patent. While rarely used, part of the review process that accompanies this type of decision includes the power of the president to overturn the ruling on public policy grounds. The ruling is the first big loss for Apple in its ongoing patent war with Samsung and could cost the company significantly, depending how various other issues unfold.

    Verizon added 1.1 million net retail wireless connections and 927,000 net retail postpaid connections in the period, leading to quarter-end marks of 101.2 million total retail connections and 95.2 million total retail postpaid connections. Wireless service revenue advanced 8.4%, and the company's wireless operating and EBITDA margins were wonderful, coming in at 22.8% and 51.1% in the period, respectively. The firm noted that Apple's (AAPL) iPhone accounted for 51% of activations in the period (up from 43% in the second quarter and 46% in the year-ago period), suggesting the smartphone maker is picking up share in the US market. The firm's wireline business saw a 1% drop in total revenue, though segment EBITDA did nudge higher from the same quarter last year. All-in, Verizon's consolidated revenue advanced 4.4%, driving adjusted earnings per share to $0.77, roughly a 20% increase compared with adjusted earnings per share of $0.64 in the prior-year period.

    Since the news about the metadata sharing was made public, rumors rose about another secret government program said to be named PRISM, which many major media providers are saying today is more than rumor. Under such a supposed program, the NSA is alleged to have access to emails and other Internet data. However, major service providers in the field have denied any knowledge of any such program and any participation in such a program. Apple (AAPL) says it does not provide any government agency with direct access to its servers. Google (GOOG) says it does not have a back door for the government to access data. Microsoft (MSFT), Facebook (FB) and Yahoo (YHOO) have also all denied being a party to any such effort. Still, at least one name remains tied to what many Americans seem to be feeling is an infringement on their privacy, and that is Verizon.

Most of the usual suspects like Kimberly-Clark (KMB) or Colgate-Palmolive (CL) are very overvalued today, which prevents me from adding to my positions there. The three companies will replace Bank of America (BAC), Hewlett-Packard (HPQ) and Alcoa (AA), all lower-priced stocks that exert a lesser pull on the price-weighted index. The changes will be effective on Sept. 23, S&P Dow Jones Indices said in a statement. The average, first established in 1896, includes 30 stocks, but very little money is indexed to its performance, unlike the broader Standard & Poor's 500 (^GSPC) or other indexes. In addition, because it is weighted by price, companies that are smaller in value with higher prices have more influence on the average. "Wow, those are big changes," said Tim Ghriskey, chief investment officer of Solaris Group in Bedford Hills, N.Y. "The Dow is really an antiquated index. It is price-weighted, which makes no sense. But there are still are some people that pay attention to it, and some technicians, so it has an influence on some people." Google (GOOG) and other names were considered for inclusion but passed over because of high stock prices, David Blitzer, managing director and chairman of the S&P Index Committee, told CNBC. The index manager said the changes were prompted by the low stock price of the three companies slated for removal and a desire to diversify the make-up of the index.     It was a good news, bad news kind of day for Chevron (CVX) yesterday, after it told investors that it would meet guidance for the third quarter but that its profit would plunge 31% from a year ago during the fourth.

    Unlike last year, when Chevron’s refining business was a drag on earnings while its so-called upstream business fired on all cylinders, now refining is providing the boost. That’s good news for Exxon Mobil (XOM) and refiners, says Morgan Stanley’s Evan Calio and Manav Gupta. They explain:

    We believe capture rates [how much of the difference between the cost of oil and refined products a company can earn. Ed. ] troughed in 3Q13 and most US refiners will show a quarter-over-quarter improvement as differentials were widening and the WTI curve moved to contango from backwardation. Positive refining revisions will positively impact [Exxon Mobil] more than [Chevron], as�[Exxon Mobil] has significantly more absolute N. American refining capacity. Marketing margins [the margins from selling the finished product to the retail market. Ed.] also improved 17% q/q and 32% q/q on [West Coast] and [Gulf Coast] respectively, a positive indicator for refiners with retail operation [(Marathon Petroleum (MPC), Tesoro (TSO), Phillips 66 (PSX), Western Refining (WNR) & Delek US (DK))].

    Shares of Chevron have dropped 2% to $1220.77, while Exxon Mobil has fallen 0.4% to $99.37, Marathon Petroleum has dipped 0.3% to $90.79, Tesoro has declined 1.3% to $57.23, Western Refining has slipped 1.2% to $40.79 and Delek US has dropped 1.7% to $33.31. Phillips 66 is little changed at $78.15.
