    kurhan/Shutterstock The maker of a line of diet supplements sold at the nation's largest pharmacies with the false promise that the pills would magically make users slender (they didn't) was banned -- at least, for now -- from selling weight loss products under a just-finalized agreement, the Federal Trade Commission said on Friday. HealthyLife Sciences and its principal sold Healthe Trim supplements with the claim you could "get high school skinny." Apparently, it only worked as advertised if its users had never gained weight after graduation. John Matthew Dwyer III (aka Matthew Dyer), the co-founder of the Atlanta-based company, agreed to stay out of the weight-loss industry under the terms of the settlement of deceptive advertising charges. Dwyer claimed the pills had ingredients that combined to burn fat, speed up the metabolism and suppress appetite. No Penalty, No Restitution The FTC said the company took in about $76 million between 2009 and 2013. Healthe Trim supplements were sold at CVS (CVS), Walgreens (WAG) and at GNC (GNC) stores. It cost consumers who bought into the spiel $50 to $65 for a month's supply, the FTC said. The key to the sales were customer testimonials featuring claims that, for example, using the pills helped one user to drop 54 pounds and go from a size 12 dress to a size 2. "Losing weight is rarely easy, and it would be a miracle if a pill made it so," Jessica Rich, director of the FTC's Bureau of Consumer Protection, said in a statement. "Consumers should be skeptical when a product like this one claims to make weight loss easy." The company itself (if it continues to operate without Dwyer) is barred from making a host of what the FTC describes as "scientifically infeasible" claims about its supplements. And it can no longer make any weight-loss-related claims at all about them until it has in hand two legitimate, scientifically rigorous human clinical-trial studies to support its statements.     Shares of health and wellness retailer GNC (GNC) rose this afternoon on news that its non-executive chairman threw down some cash and bought up some shares.

    On Aug 18, Michael F. Hines bought 30,000 shares for $1 million, an average of $35.44. This marks his third open market transaction on record. His prior two were options exercises and sales.

    Analyst Charles Grom of Sterne, Agee & Leach considers this a bullish move for GNC and writes in a note, ��Hines��purchase is] a nice vote of confidence for shares, which are down considerably in 2014.��With the stock down 37% so far this year, we’d say he’s right.

    On July 29, GNC slid to a low of $30.84. Shares have climbed since then, and today gained 1.5% to $36.93.

Facebook (FB) -- Winner Shares of the leading social networking website operator hit new highs on Thursday after it posted another quarter of blowout results. Facebook now sees 1.23 billion unique monthly visitors, 16 percent ahead of where the site's traffic was at a year earlier. Folks are also coming more often, with daily active users up 22 percent. The company has done a great job of monetizing both its desktop site and its mobile app. Online ad revenue soared 74 percent during the quarter. The market was clicking the "Like" button when the report came out, sending the shares 14 percent higher on Thursday. Apple (AAPL) -- Loser These days, Apple lives and dies by the iPhone, and that explains why the stock took a hit on Tuesday after it reported weak sales for its new smartphone. Apple sold a little more than 51 million iPhones during the holiday quarter. This is certainly an impressive number, but analysts were hoping for closer to 56 million devices. The culprit in the shortfall is clearly the iPhone 5c. We know this because it's the one that was readily available after the pricier iPhone 5s sold out during the debut weekend for both products. It was confirmed this week when Apple reported a healthy uptick in average selling prices for its iPhone, implying that the more expensive smartphone was the hotter seller. Apple was trying to make a dent in the entry-level market with the iPhone 5c, but consumers weren't wowed by its pastel colors, its plastic shell, and specs that were inferior to the iPhone 5s, which sold for just $100 more.     Nissan (NSANF) said it is not aware of any deaths caused by the problem, but can not give details about resulting injuries.

    The problem is with the sensors in the front passenger seats that are supposed to tell if an adult or a child is sitting on the seat. Because the risk of injury or death to child is greater from an airbag than from an accident itself, if the system senses there is not enough weight in the front passenger seats, that airbag will not deploy.
